I just received a notice that the Planning Commission will take up the issue
of certification of the 301 Airport Boulevard EIR at the meeting next Monday
night - 12/13. After they indicated that they would move the whole matter
over to January, the chair of the Commission and the City Planner apparantly
talked and decided to split overall approval and EIR certification. I
received a notice mailed 12/8/99.

The draft resolution for certification does include the following language to
address the issue of the flawed EIR standard (looking at wind velocity but
not at turbulence) used in the 301 Airport Boulevard EIR:

"Whereas, certification of this Final EIR shall not in any way be construed
or interpreted as the adoption of a City policy, standard or threshold for
evaluating the effect of any other project on ambient winds on the San
Francisco Bay or elsewhere and shall not constitute precedent of any kind for
any other project, whereever located..."

The primary problems with the EIR the flawed significance criteria and a
failure to properly evaluate the revised project. The developer had wind
tunnel tests conducted for west winds for the new project but not for winds
from a more northly direction (like WNW) which would be more serioulsy
affected according to the wind tunnel expert.

The Planning Commission asked for WNW tests after I argued they were required
under CEQA guidlelines on Standards for Adequacy The City has asked the
developer to do WNW tests rather than having ESA, the City's consultant do
it. They now are moving to certify the EIR without having the WNW test info
in hand or publically released.

The Planning Commission is now looking at having approval meetings at special
sessions so that they do not have the rest of their regular calendar buried
under the 301 Airport issue. They will likely select two consecutive nights
in January to hold the approval hearings and take comments. They would
continue on night 2 if all testimony could not be heard on the first night.
